Androidacy Community Contribution Licensing Policy


Introduction

This document, known as the Community Contribution Licensing Policy (“Policy”), sets forth the legal terms and conditions governing the submission, use, and distribution of works on Androidacy’s platforms. This Policy complements our General Terms of Service and Privacy Policy and is subject to the laws of the United States.

Commitment to Intellectual Property Rights

At Androidacy, we firmly stand by the rights of authors and creators, recognizing the value and importance of their intellectual contributions. We categorically declare that we have never and will never knowingly engage in activities that infringe upon such rights. If any party believes that their intellectual property rights have been compromised via our platform, we encourage them to promptly communicate their concerns through our Contact Page.

Section 1: Submitters of Works

  1. Warranties and Representations: Individuals or entities submitting works to Androidacy affirm and warrant that they possess full legal rights and authority to do so. They further assure that their submissions do not in any way infringe upon or violate the intellectual property rights, privacy rights, or any other rights of third parties.
  2. Grant of License: By submitting works to Androidacy, the submitter agrees to grant Androidacy a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish, and distribute these works across our services. This grant includes the right to make modifications to the work as necessary for integration into our services and the right to sublicense these rights.
  3. Indemnification Clause: The submitter agrees to indemnify, defend, and hold harmless Androidacy from any claims, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from or related to the submitter’s breach of any representations and warranties mentioned in this section.

Section 2: Creators of Works

  1. Intellectual Property Ownership: Creators retain all proprietary rights, including copyrights and trademarks, in their works. Submission of their works to Androidacy’s platforms implies granting the same license to Androidacy as stated in Section 1.
  2. Attribution and Moral Rights: Androidacy commits to providing appropriate credit to creators whenever their works are used within our platforms, consistent with industry standards and creators’ preferences, while also respecting their moral rights.
  3. Specific Licensing Terms: Should a creator’s work be governed by specific licensing agreements (e.g., open-source licenses), it is incumbent upon the creator to provide clear and conspicuous notice of such terms at the time of submission.

Section 3: Users of Works

  1. License Compliance: Users accessing works through Androidacy’s platforms are bound to adhere to the terms of the specific licenses under which such works are distributed. Users must review and understand these terms prior to use.
  2. Usage Restrictions: Unless expressly authorized by the specific license of a work, users are limited to personal, non-commercial usage of the works. Any commercial exploitation or redistribution of the works is strictly prohibited.
  3. Prohibition of Unauthorized Activities: Users are expressly prohibited from engaging in any form of unauthorized reproduction, modification, or distribution of the works accessed through Androidacy’s platforms.

Advertising and Revenue Generation

  1. Advertisements: Androidacy incorporates advertisements within its services as a means to defray operational expenses. These advertisements should not be interpreted as a mechanism for monetizing the intellectual property of others but as a mechanism to keep our services sustainable. No advertising will be injected or otherwise input by Androidacy off of our services.
  2. Non-Endorsement: The inclusion of any work within Androidacy’s platforms does not imply endorsement of any products or services advertised therein.

General Provisions

  1. Policy Modification: Androidacy reserves the right to modify or amend this Policy at any time. Such modifications become effective immediately upon posting on our website.
  2. Jurisdiction and Governing Law: This Policy shall be governed by and construed in accordance with the laws of the United States, and any disputes arising hereunder will be resolved exclusively in the competent courts of the United States.
  3. Severability: In the event that any provision of this Policy is deemed invalid or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
  4. Good Faith Assumption and Limitation of Liability: Androidacy operates under the assumption that all submissions are made in good faith. However, Androidacy disclaims all liability for inadvertent infringements or faults within our systems.
